Biocidal Products Regulation (BPR)

The Biocidal Product Regulation (BPR, Regulation (EU) 528/2012) concerns the placing on the market and use of biocidal products, which are used to protect humans, animals, materials or articles against harmful organisms, like pests or bacteria, by the action of the active substances contained in the biocidal product.

BPR Regulation (EU) No 528/2012

From September 1st 2013 Ozone is regulated as an active substance under Regulation (EU) No 528/2012. The BPR requires both active substance approval as well as biocidal product authorisation for ozone equipment.

REACH REGULATION (EC) No 1907/2006

REACH (Regulation (EC) No 1907/2006) is the Regulation for Registration, Evaluation, Authorisation and Restriction of Chemicals. It entered into force on 1st June 2007 to streamline and improve the former legislative framework on chemicals of the European Union (EU). REACH aims to improve the protection of human health and the environment from the risks that can be posed by chemicals, while enhancing the competitiveness of the EU chemicals industry.

REACH places with the principle “no data no market" greater responsibility on industry to manage the risks that chemicals may pose to the health and the environment.

The use of ozone for oxidation is falling under the scope of the REACH regulation and requires the registration. Importantly the last deadline for compliance is 31 May 2018. This is affecting the majority of ozone systems use for oxidation. REACH is regulating the bringing to market by users/operators of ozone equipment (dependent on yearly mass of ozone produced).
